TERMS AND CONDITIONS OF EQUIPMENT OR PARTS SALE
This Equipment or Parts is sold by A.R.E. Industries under the Warranty set forth in the following paragraphs. Such Warranty is extended only to the Buyer who purchases the Equipment or Parts directly from A.R.E. Industries or its authorized Distributor as new merchandise. There are no other Warranties which extend beyond the contents of this Warranty, whether it be verbal or past warranties in literature or descriptive form. This Warranty supersedes all others supplied by A.R.E. Industries.
A.R.E. Industries Warrants that any New Equipment manufactured by A.R.E. Industries will be free from defects in material or workmanship for a period of 12 months from date of delivery, other than its expendable parts, electrical components, components that are not of A.R.E. Industries manufacture, or damage to Equipment or Parts due to deterioration or wear, occasioned by chemical, abrasion, corrosion, improper operation or maintenance, improper setup, alterations of Equipment, abnormal conditions, or beyond the rated capacities or design of Equipment or Parts.
A.R.E. Industries will not pay any claims for any expense of Buyer relating to labor, productive facilities, lost profits, downtime, property damages, personal injuries, direct or indirect "Acts of God", freight or freight damage, delays in performance of Equipment or Parts, material purchased by Buyer or any other cause beyond A.R.E. Industries control.
Equipment or Parts returned to A.R.E. Industries for manufacture defects or workmanship must have a RGA # from A.R.E. Industries and freight must be prepaid. A.R.E. Industries shall at its option: replace Equipment or Parts, F.O.B. A.R.E. Industries (freight collect) or repair defective Equipment or Parts, or accept Equipment or Parts prepaid and refund prorated purchase price.
A.R.E. Industries does not Warranty the fitness condition or appearance of the product or specific applications by the Buyer, unless A.R.E. Industries specifically agrees in writing to do so. Buyer acknowledges that A.R.E. Industries has relied upon the specifications, details, data, and requirements supplied by the Buyer in the design and performance of Equipment or Parts purchased by Buyer. If the actual conditions of performance of Equipment or Parts differ from the conditions that Buyer represented to A.R.E. Industries, any Warranties or Performance guarantees affected by such differences shall be null and void.
A.R.E. Industries assumes no responsibilities or liabilities for compliance with Federal, State, and Local laws or regulations, or Environmental laws or regulations. This is the sole responsibility of the Buyer.
Design changes are frequently made on Equipment or Parts manufactured by A.R.E. Industries as well as purchased components because we are eager to adopt new ideas, materials or components to improve A.R.E. Industries products. If your Equipment or Parts do not coincide exactly with illustrations, literature, or information given by A.R.E. Industries, it is because of improvements to the products Specifications or designs are subject to change without prior notice. A.R.E. Industries may subcontract any portion of the work or design of any products sold by A.R.E. Industries.
A.R.E. Industries has a security interest in all Equipment or Parts sold to Buyer until A.R.E. Industries receives payment in full. A.R.E. Industries, at its option, may accelerate or demand all payments due at once or return of Equipment and Parts, if Buyer fails to make any payment when due.
No Equipment or Parts whether Warranty or non-warranty shall be returned without a RGA # and freight prepaid. All Equipment and Parts must be received within 30 days of date shipped or no credit will be issued.
All Equipment and Parts returned must have a RGA # visible on the outside of package or on Equipment shipment, or they will be refused. Any defective Equipment or Parts returned are subject to examination before any credit will be issued.
All non-warranted Equipment or Parts are subject to a 20% restocking fee.
In the event of refusal of a shipment being Equipment or Parts, regardless of the reason, the Buyer is still responsible for a 20% restocking fee and all freight charges including storage incurred.
All electrical parts, specialty orders or parts designed for Buyer's needs or Buyer's Equipment are not returnable.
Returned Equipment or Parts are credited for the amount less applicable charges only, no freight credit will be issued.
Buyer's charge account with A.R.E. Industries must be within credit terms. Equipment or Parts that are subject to Warranty or Return must be paid for before returning or credit issued.
